Quel est le statut des travailleurs en cong\u00e9 sans solde en raison de la crise du Corona ?<\/h3>\n

La crise du virus Corona affecte gravement l’activit\u00e9 \u00e9conomique des entreprises, posant aux propri\u00e9taires d’entreprises des dilemmes commerciaux complexes auxquels ils n’ont pas \u00e9t\u00e9 confront\u00e9s auparavant. La question centrale semble \u00eatre la question de savoir ce qu’il adviendra du sort des employ\u00e9s dans les entreprises dont ils sont propri\u00e9taires. Au moment de la r\u00e9daction du pr\u00e9sent article, environ un demi-million de travailleurs ont d\u00e9j\u00e0 \u00e9t\u00e9 mis en cong\u00e9 sans solde, et on estime qu’il y aura pr\u00e8s d’un million d’employ\u00e9s (et peut-\u00eatre m\u00eame davantage) en cong\u00e9, \u00e0 la suite de la crise du Corona. La question se pose de savoir si, d’un point de vue juridique, un employ\u00e9 peut \u00eatre licenci\u00e9 pendant un cong\u00e9 sans solde et quelles sont les cons\u00e9quences juridiques d’un tel cong\u00e9.<\/p>\n

Comme nous l’avons not\u00e9 dans un autre article publi\u00e9 sur le site Web de notre cabinet, qui traitait de la question des cadeaux de f\u00eate pour les employ\u00e9s, les relations de travail ne se rompent pas lorsque les employ\u00e9s sont en cong\u00e9 sans solde, mais entrent dans une p\u00e9riode de suspension. Les droits des employ\u00e9s accumul\u00e9s jusqu’au moment de leur d\u00e9part, tels que leurs droits \u00e0 une pension, sont conserv\u00e9s. Cela implique de donner aux employ\u00e9s un pr\u00e9avis de licenciement, puis de tenir une audience avant le licenciement. Deux questions importantes concernant le licenciement de travailleurs en raison de la crise de Corona concernent la dur\u00e9e du cong\u00e9 et le non-retour des travailleurs sur le lieu de travail apr\u00e8s le cong\u00e9. Premi\u00e8rement, le Tribunal national du travail a statu\u00e9 dans une s\u00e9rie de d\u00e9cisions qui ne sont pas limit\u00e9es dans le temps, telles que le licenciement, et \u00e9tablit l’admissibilit\u00e9 \u00e0 l’indemnit\u00e9 l\u00e9gale de d\u00e9part.
